According to his interview with Good Morning America, motorcyclist Zachery Perez had passed a vehicle due to the driver's erratic behavior.  Shortly after, he ended up in front of the same vehicle and as traffic stopped on the Dallas North tollway the vehicle did not stop and instead slammed into Perez, throwing him from his bike and into oncoming traffic. 

Despite being severely injured, Perez was able to move out of the path of an SUV that was coming at him.  Perez, a U.S. Army veteran, sustained serious injuries during the motorcycle crash to include a broken rib, ruptured spleen, four broken vertebrae and a lumbar hernia.  Since the crash, Perez has undergone multiple surgeries, but he is glad to be alive.  Though his injuries were many, he believes that if he had not been wearing a helmet his injures would have been much worse.

"If I wouldn't have worn my helmet, I don't think I'd be here right now.  I'd still be in the hospital or I'd probably be dead," Perez said during an interview with ABC News. 

Though happy to be alive, Perez is upset that the driver that hit him was not arrested.  The driver, uninsured, without a license and clearly at fault, received a few tickets but was not arrested.  Perez, along with motorcycle advocates nationwide, are unhappy that the driver was not held responsible for his actions and will not face serious legal action.
