workers comp for a workplace knee injury The Hart Law FirmWorkers performing many different jobs can suffer debilitating knee injuries that require them to take months or longer off work while they recover. If a worker is employed in Texas, he could find that his employer is a non-subscriber employer who has opted out of providing workers’ compensation benefits. In this situation, an employee must prove that the employer’s negligence—even as little as one percent—was the cause of his knee injury in order to be entitled to compensation for his injuries.

Will You Need to File a Non-Subscriber Workplace Injury Claim for One of These Common Knee Injuries?

Knee problems can be the result of an acute injury caused by an incident such as a fall, or an injury that occurs over time due to overexertion. Knee injuries can damage the ligaments, tendons, fluid-filled sacs known as bursae surrounding the knee joint or the bones, cartilage, and ligaments that make up the knee joint. A knee injury can cause chronic pain and limitations in a person’s ability to stand and move—often making it impossible for a worker to perform his job duties while receiving treatment. Common knee injuries that workers suffer include:

ACL injury.

An ACL injury is the tearing of a major ligament in the knee—the anterior cruciate. It is often caused by sudden movements, like jumping, stops, or changes in direction. It can cause pain, swelling, and instability of the knee that can make movement or placing weight on the knee very difficult.

Fractures.

Fractures of the knee cap or other bones in the knee joint can be caused by a fall, car wreck, or other incident that causes blunt force to the knee. This can cause pain, swelling of the knee, and difficulty walking and standing.

Meniscus tear.

The meniscus is the rubbery cartilage in the knee that acts as a cushion between the shinbone and thighbone. It can be caused by a sudden twisting of the knee, an impact to the knee, or overuse or arthritis over time. Symptoms can include pain, swelling, locking of the knee, and difficulty straightening the knee and walking.

Bursitis.

Knee bursitis occurs when the fluid-filled sacs surrounding the knee become inflamed. While any of the bursae can become inflamed, the sacs above the knee cap or on the inner side of the knee are the most common ones to be injured. It can be caused by blunt force, kneeling, or overuse while at work. A person can experience pain and limitations of movements.
